With Rick being an experienced DUI attorney, questions arise from previous clients, current clients, as well as those who are considering hiring Rick for a DUI charge. A frequent question that we receive is “am I able to go to Canada with a DUI?” It is a bit more complicated than a yes or no answer.
Run for the Border
Because we are so close to the Canadian border, spending the day or even a couple of days in our neighboring country Canada is quite common for people in Washington State. But prior to making a quick trip up north, you need to be aware of the rules and restrictions that may prevent entry into Canada.
You are waiting patiently in line at the border crossing. As you approach the border an immigration officer will require to see the proper documents to allow entry. The Canada Border Services Agency has a list of several documents that are acceptable for a United States citizen to use to cross the border. It is important to check your documents prior to making any trip across an international border, each country has requirements to cross, however, you want to make sure that you have the proper documents to gain re-entry into the United States. A list of those documents for re-entry are here at the US customs and border protection website.
Pending DUI Charge
You could be deemed Inadmissible into Canada if you have a pending DUI charge. According to the Canadian Immigration law if you have committed or been convicted of a Driving while impaired you will probably be deemed inadmissible into Canada. However, Canada does have a permit that you can apply for that can potentially allow you entry into Canada.
If you are considering traveling to Canada, and you have a pending DUI charge, or have been convicted of a DUI, please give Rick a call. He can walk you through the steps you would need to take so you can take your trip. It will probably save you a bit of time and frustration if you know ahead of time what to expect at the border, instead of getting to the border and being denied entry.
