Girl Scout Cookies With A Vision…

The sales of Girl Scout cookies provide funds for great learning adventures, and other opportunities for girls.  Last year our Girls Scouts were earning money to keep having fun learning, Girl Scout camp, and a trip to Disneyland.

In addition these Girl Scouts are learning a variety of valuable life skills while they are setting up, selling and reporting their sales of these delightful morsels.

For the past several years Merrill Law has been supporting this Girls Scout Cookie sales. We are looking for 10 Girl Scouts to sign up and sell us 5 boxes of delicious cookies.

  • We will place our order from the first 10 Girl Scouts to submit this request.
  • We like to share a photo of the girls who stopped by the office with cookies to sell to Rick.
  • You can decide if your parent will email a photo to us, or if we will stage a no contact photo of the delivery on our porch.

What happens when you are arrested for DUI

I am going to talk about what happens when you are arrested for a DUI in Washington State. Hello, I am Reece Merrill with Merrill Law.

Two Processes

If you get arrested for a DUI in Washington State, there are two processes going on. One is the administrative process with your license, which will be governed by the DOL (Department of License). The second process is governed by the Courts and that determines any kind of criminal punishment, aside from a license consequence, potentially going jail although hopefully not.

Department of License

Now the process with the DOL, the DOL will move much faster than the courts. The courts have 2 years to file any case against you as a result. The DOL will move much quicker. You will have 5 business days to request a hearing for the administrative process of suspending your license. If you get arrested for a DUI it is very important that you talk to an attorney about that DOL hearing fairly quickly. And the strategy you want to take there whether or not you want to request it or get the restricted license. But we should be able to help you keep driving in some way.

The Court

So for the Court side, at some point within the two years from the date of the violation, the date you have for your arrest or had contact with Law Enforcement. They will schedule your first court appearance which is called the Arraignment. At the arraignment it is time to enter a plea. You will want to be pleading not guilty. The court will also set some conditions of release. The basic conditions for a DUI that the court will set at the arraignment will be don’t commit any criminal law violations while the case is pending. Don’t drive without a valid license and insurance. Don’t get another DUI. And depending on the jurisdiction there might be an Ignition Interlock requirement. That is going to be more dependent on your individual criminal history as well as the jurisdiction that the case is in.

At that arraignment date they will set Pretrial hearings. Which are just status hearings to let the court know if you are ready to resolve the case or ready to tell the court that you are ready for Trial and then set for a Trial date. Generally at that first hearing most people won’t know whether or not they want to go to Trial. So there will probably be multiple court dates.

After the court sets the conditions, they are also going to set Pretrial court dates at the first hearing, the arraignment. The Pretrial hearings are for letting the courts know the status of the case. Either we want to declare that we are ready for trial, we want to ask for more time to investigate and negotiate the case, or we have some kind of resolution that everyone can be happy with. So it is possible that the case gets resolved at the first Pretrial hearing, but it is not outside of the ordinary that there would be multiple Pretrial hearings. The reason for that is to give the attorney more time to investigate and negotiate the case. Potentially there are some affirmative conditions that the State wants done before the case can be resolved. And things of that nature.

That is the basic outline of the process, both with DOL and with the Courts.

Free Shred Event 2022

2022 Free Shred Event Complete

Thank you to everyone who made the Free Shred Event 2022 and Food Drive a Success. We were able to fill the truck completely this year.

The ProShred truck was late to arrive. They were over scheduled due to the unexpected loss of one of their trucks in a recent fire. However as soon as the truck arrived all of the boxes and bags that were dropped off were shred.

We are happy to say that we filled a mini van with about 500 pounds of food donations and $300 dollars that were donated for the food bank.

2021 Educators of the Month Winners

2021 Educator of the Month Winners

Rick Merrill presents the Educator of the Month award to outstanding educators in Snohomish County.  The recipient receives a plaque and $500 to help defray miscellaneous expenses for the classroom.

The Law Offices of Rick H. Merrill has been a part of the Snohomish County community since 1994.  It is important to Rick to support our neighbors, local businesses and schools.  Rick partnered up with local radio station KXA 1520 am to sponsor a local educator each month.  Rick Merrill is recognizing our educators for their hard work and sacrifices. Who demonstrate their care and commitment to each generation of children.  

Winners are presented a plaque donated by Awards Service, Inc., a great big check to display, and $500 to help defray miscellaneous costs for the classroom.

Mr. Flanders is an Amazing teacher, who engages students. Excellent math teacher who goes above and beyond to teach kids who struggle. Mr. Flanders is also a teacher many feel safe talking with. Many students have taken the opportunity to talk with Mr. Flanders and his door is always open to talk with, eat lunch with or get some extra help.

I have never known a teacher who goes so above and beyond for his students. Mr. Flanders is also very active in the food drive within the school, helping students collect as much as possible in a variety of ways. He takes the opportunity to truly get to know each and every student and their learning style early in the semester so he can best cater his teaching style for all in his classes, Mr. Flanders is truly a teacher that goes above and beyond.

Congratulations To Our 2021 March Educator Of The Month, Sara Coiley of the Everett High School.

Words cannot describe the impact Sara Coiley has had on my life (both academic and personal).

When I was a student in high school I was quite shy and very nervous. Sara took the time out of her day to connect with me and to give me the confidence to pursue theatre. If it wasn’t for Sara, I wouldn’t be where I am today.

She pulls resources together like nobody’s business and works with a club budget that isn’t nearly large enough for the program. Her time at Everett High has brought more students, diversity, and love into the arts and drama department at the school.

About the Everett High School Drama Club: The Theatre Program has over 100 students who partake in Theatre and Technical Theatre classes, and includes almost 100 students who participate in extra-curricular plays, improv and musicals each season. Our curriculum courses offered are Beginning Drama, Intermediate/Advanced Drama, Technical Theatre I, II & III. All drama courses are semester long and students receive 0.5 fine arts credit; our technical theatre I course is a full year course in which our students receive a 1.0 fine arts and 1.0 CTE credit; technical theatre II & III are both semester courses and students receive 0.5 fine arts and 0.5 CTE credit. Our extracurricular program provides opportunity for students to earn varsity letter and points toward induction into the International Theatre Society – an honor society for the performing arts.

My son has struggled with math during his grade school days and never got a grade higher than a B minus. He went to middle school and was very scared about his math.

His math teacher, Miss Rickert has offered after school tutoring for him twice a week and sends weekly emails to me regarding his progress. Under Miss Rickert, my son is now getting a 3.7 (A) grade, largely due to her assistance after school and inspiration. My son’s overall confidence has improved tremendously.

Lanna Duncan is quite frankly the best thing that has happened to our school during the 9 years I have been employed at Totem Falls Elementary. Lanna came to us beginning in the 2018-19 school year as the first full time counselor we have been able to have. The energy, and fun demeanor is something that we desperately needed! The non-stop energy she has is amazing…and just before the school year she had a baby…she had every excuse in the world to be dragging daily…not her! Since joining our school she has joined me in being an advisor for our student counsel, a lead in our assembly creation team, and her many small groups she meets with daily/weekly to enrich the lives of students who need that extra bit of love. Since we have been in this online/distance learning model she not only checks in with her students that are on her own case load, but will check in with every single staff member to see how they are doing and if there is anything else that she can do to help them…all while going above and beyond doing her own job. She’s quite frankly amazing and I feel so blessed to not just call her a co-worker but a great friend as well. I can’t think of anyone more deserving of this honor.

Donations For Beck’s Place In Monroe.

We are accepting donations of dog and cat food and supplies, hygiene items, household cleaning supplies, sleeping and outdoor supplies, or clothing.  These donations are shared with those in our local community who are struggling. Beck’s Place helps people and pets in a special way year round.

Donations For The Food Bank

If you have non-perishable food to donate to the local food bank you can drop them off here. We will bring in all Donations left outside the next business day, and deliver them to the food bank for you.

Fireworks: Fun While it Lasted

Fireworks offenses are a criminal charge. These come with the possibility of monetary penalties and time spent in jail.

The most common fireworks offenses are unlawful possession of fireworks and the unlawful discharge or use of fireworks.  

Possession Fireworks

The local fireworks retailers usually carry fireworks that are classified as “Consumer Fireworks”.  The list of consumer fireworks is published yearly by the State Fire Marshall. You will find It posted at the sales stands. 

Officers will use the quantity of fireworks in your possession, as the measurement that determines if you have violated the law. 

You may be charged with a misdemeanor or gross misdemeanor.  A misdemeanor conviction comes with a 90 days maximum penalty in jail and a $1000.00 fine.  A gross misdemeanor conviction comes with a 364 days maximum penalty in jail and a $500.00 fine.

Illegal Fireworks

Include Firecrackers, rockets, M-80’s, dynamite, and all homemade fireworks and others that do not follow the definition of “Consumer Fireworks”

Unlawful Discharge or Use of Fireworks

It is illegal for anyone to discharge or use fireworks that creates a substantial risk of death or serious physical injury to someone or damage to someone else’s property.  This violation is a gross misdemeanor.

Discharge of fireworks have approved dates, times and locations. Maps and instructions are available on the County Websites. You will want to verify that you will be lighting your fireworks in an approved location. You can look at the local rules at the following links.

To Pay Your Medical Bills

A lot of people think that somebody ran into my car, I got injured, so that person’s insurance company is going to pay for all of my medical bills, and it is going to be fine. My insurance company is not necessarily involved. And that is not really the case.

Personal Injury Protection

Most of the time they have Personal Injury Protection. Someone hits my car, I have auto insurance, I have Personal Injury Protection, most people have it, through their auto insurance. That Personal Injury Protection is going to pay your medical bills until this settlement is reached from the at fault insurance company. The at-fault insurance company is not going to pay your medical bills, yet.

The Settlement

The settlement that we send out, we will send them the demand saying, these are all the damages that my client suffered. Give us this much money.

The at fault insurance company is going to settle. We will agree on a settlement, we will negotiate, whatever the settlement is. The money that your insurance company paid for your medical bills is going to get reimbursed, at a reduction. So most of the time they will reduce one third, so if they pay out $10,000, we only have to pay back $6,666. The rest of that money goes to you.

The Settlement Includes Money To Pay Your Medical Bills

So a lot of people think that the at-fault insurance is going to pay for everything. That is not necessarily the case, usually they are not going to pay until the settlement is reached. But the settlement is going to include all of your medical bills to reimburse whoever has paid for it at that time. Whether it be your auto insurance, or sometimes your health insurance will pay for your medical bills with the intention that they are going to get reimbursed at the settlement.

A lot of people say well this person injured me, so they are going to pay for everything right now, but that is just not really how life works. That is not the system that we have, but that is why you hire us.

I am in contact with them all the time, I am sending them emails, I am calling them. Hey, how’s your treatment going? How is your recovery? I am involved in their life for three years at a time. And if it goes to court, even longer. 

When I can work with a client, and get to know them. Really, you know, you make friends. You make these relationships and you are helping out a person the whole time. To get them a settlement that they are happy with. 

I enjoy working with people to settle their case.

 It is stressful up until that point.  And there are certain points, just like in life, there are certain things that are very stressful, But then you work past them. 

It is great to get to know the clients and help them get the settlement that they are happy with. That is what I enjoy most about it.

Gotten many tickets dropped or the charge reduced to a non moving violation. Yes it would be great if they all could be dropped but at the end of the day my insurance is still affordable. Anyone leaving bad reviews about the Merrill's not getting a charge totally dismissed did not listen or read well enough when entering the contact as they make it very clear that both are a possibility.
